Terms governing our SMS/text messaging service

1. Program Description

By enrolling in the SMS/text messaging service ("Service") provided by Kiva Insurance, LLC ("Company," "we," "us," or "our"), you consent to receive recurring automated and/or non-automated text messages, including but not limited to: promotional offers, product updates, service alerts, and transactional notifications. Message frequency will vary.

2. Consent to Receive Messages (TCPA & Arizona Law)

By providing your mobile telephone number and opting in to the Service, you:

  • Affirm that you are the subscriber or customary user of the number provided.
  • Provide express written consent to receive automated marketing and informational text messages from the Company at the number you provide.
  • Understand that consent is not a condition of purchase.
  • Acknowledge that all marketing communications will comply with the Arizona Consumer Fraud Act, meaning they will not be false, misleading, or deceptive.

3. Message & Data Rates

Message and data rates may apply to each message sent or received, as provided in your mobile telephone service plan. Please contact your wireless carrier for details.

4. Opt-Out Instructions (TCPA, CTIA & Arizona Compliance)

You may opt out of the Service at any time by replying STOP to any message you receive. Upon receipt of your opt-out request, we will send a single confirmation message to confirm your withdrawal from the Service. No further messages will be sent unless you re-enroll.

6. Privacy & Data Protection (GDPR, CCPA & Arizona Law)

We respect your privacy and are committed to protecting your personal data.

  • Data Sharing: We do not sell, rent, or share your personal data with unaffiliated third parties for their own marketing purposes without your explicit consent, except as required by law.

9. Changes to Terms

We reserve the right to modify or terminate the Service or these Terms & Conditions at any time. Any changes will be effective immediately upon posting to our website or sending you a notification. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.
